An employer can successfully be held liable for personal injury resulting from a subordinate's mistake if there is a functional connection, which means the following: The likelihood of an error is increased by the employer's instructions, and the employer has control over the actions that led to the error. In practice, this means that your boss is liable for almost all accidents that occur during working hours.


Exception for employer liability

If your colleague acted recklessly, they may be held (partially) liable. This is the case, for example, if they were working under the influence of drugs or alcohol, or if they deliberately caused the accident.
